● Background
On October 17, 2014, Indonesia promulgated Law No. 33 of 2014 on Halal Product Assurance (HPA Law), which came into effect on October 17, 2019. Subsequently, on February 2, 2021, Indonesia introduced Government Regulation (GR) 39/2021 regarding the implementation of halal product guarantees. These regulations require various goods and services to obtain halal certification.
Halal certified products must include halal labels on their packaging. Non halal products, i.e. products without halal certification, must indicate their non halal nature on the packaging.
At present, there is a transitional period for mandatory halal certification of halal cosmetics, which is expected to end on October 17, 2026.
●Non halal information labels for non halal products
On March 24, 2024, the Indonesian Halal Product Assurance Organization (BPJPH) published an article on its website emphasizing that products containing non Halal sources or containing non Halal materials are not subject to Halal certification requirements. As these products are exempt from halal certification, they can still be traded as long as their non halal nature is clearly indicated. For example, products containing pork must include text or images depicting the pork on the packaging.
According to Article 92 of GR 39/2021, it is required that business operators who produce products using non halal ingredients include information about the non halal nature of the products. Non halal information identification should meet the following requirements:
It can be in the form of images, symbols, or written text;
It can be included on the product packaging, specific parts of the product, or certain locations of the product;
In the product ingredient section, non halal ingredients should be clearly colored, such as red;
It must be easy to see, clear, and not easily erased, removed, or damaged;
Failure to properly label non halal products may result in written warnings.
