Definition of Cosmetics in Vietnam

According to Vietnamese law, cosmetics are defined as any substance or preparation intended for external application to human body parts (such as skin, nails, hair, lips, teeth, etc.). The primary purposes of cosmetics are cleansing, caring, deodorizing, protecting, or altering appearance and health conditions. The cosmetics industry covers the following product categories:

  1. Hair care products

  2. Makeup products

  3. Skincare/care products

  4. Masks and lotions

  5. Soaps and fragrances

  6. Oral care products

  7. Nail care products

  8. Shaving products

  9. Sunscreen products

When classifying cosmetics intended for registration in Vietnam, it is important to note that certain products with medicinal, pharmacological, or immunological effects are not classified as cosmetics but must be registered as drugs, which involves stricter regulatory compliance requirements.


Regulatory Background

As a member of the Association of Southeast Asian Nations (ASEAN), Vietnam has fully implemented the ASEAN Cosmetic Directive (ACD) through Circular No. 06/2011/TT-BYT on Cosmetic Management, issued on January 25, 2011. According to this regulation, cosmetics must undergo a notification procedure, and only after the competent authority issues a cosmetic notification receipt number can the applicant sell the cosmetic products. The notifier is also responsible for the safety, efficacy, and quality of their products.

Documents Required for Notification

  1. Business license of the Vietnamese company

  2. Letter of Authorization (LOA) from the manufacturer or product owner

  3. Certificate of Free Sale (CFS)

  4. Scanned copies of the product's inner and outer packaging labels

  5. Product formula table (English INCI, concentration)

  6. Token registered with the General Department of Customs (digital signature token)

Product notification: 20-25 working days
Notification validity: 5 years

The PIF includes the following four major sections:

  1. Administrative documents

  2. Quality and safety data of cosmetic ingredients—raw material quality and safety information

  3. Product quality and safety data

  4. Product safety and efficacy data—such as safety assessment reports, test reports, efficacy reports, etc.
