Vietnam is revising its advertising law to prohibit the misuse of cosmetics as drugs

● Latest regulatory updates on cosmetics advertising in Vietnam                         

On February 26, 2024, the Vietnamese Chamber of Commerce and Industry (VCCI) announced the revised and supplementary draft of the Advertising Law. The draft was drafted by the Ministry of Culture, Sports and Tourism (MOCST), which includes three new requirements specifically for cosmetic advertising:

◆1) Cosmetic advertisements must include the following information: the name of the cosmetic, its characteristics and use, the name and address of the organization or individual responsible for marketing the product, and any warnings required by international agreements.

2) It is prohibited to distort cosmetics into drugs in advertisements.

3) Cosmetic advertisements on audiovisual and print media must clearly state the name, characteristics, and use of the cosmetics, as well as any warnings required by international agreements.

VCCI is seeking public opinion and feedback on the draft.

● Vietnam's Requirements for Cosmetic Advertising                                            

1. In addition to filing with the Vietnam Drug Administration (DAV), cosmetics advertising also requires approval from the Ministry of Health (MoH).

2. The advertising content must comply with

1) Information in cosmetic filing

2) Security and effectiveness support documents

3) Cosmetic claims guide.

3. Prohibited behavior

1) Advertise using words such as "best", "best", "unique", "first" or similar meanings without legal documents.

2) Use images, clothing, names, letters, and articles of medical institutions, doctors, pharmacists, and other medical personnel for advertising.

3) The way cosmetics are advertised leads people to confuse them with drugs.
